General Terms and Conditions

1. Binding order without right of return or cancellation

   The production of our films in the area of window decors is carried out individually with regard to colours and dimensions for the respective customer.
   
   This is a customised product for which EU law Article 246a § 1 paragraph 2 sentence 2 EGBGB does not provide for a right of return.
   
   "The right of cancellation does not apply to contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer."

2. Scope of application

These General Terms and Conditions apply exclusively to contracts concluded via the Profil Dekor GmbH & Co KG online shop.

Retention of title

The goods remain the property of Profil Dekor GmbH&Co.KG until the purchase price has been paid in full.

Warranty / Guarantee

(1) The rights of the buyer in the event of defects are governed by the statutory provisions.

(2) For private individuals, the warranty period is generally 2 years. For commercial buyers, the warranty period is limited to 1 year.

(3) The agreement of a guarantee extending beyond this must be in writing to be effective.

Availability of the goods

If we are not supplied ourselves, although we have placed congruent orders with reliable suppliers, we shall be released from our obligation to perform and may withdraw from the contract. We are obliged to inform the customer immediately of the non-availability of the service and will immediately reimburse any consideration already paid by the customer.

Payment

(1) For customers with a billing address and bank account within the Federal Republic of Germany, payment shall be made in advance for the first order (credit card, bank transfer, sofortüberweisung.de or PayPal). From the second order, payment by invoice is also possible for registered customers with a billing address and account within the Federal Republic of Germany up to an amount of €60. For customers with a billing address or account outside the Federal Republic of Germany, only payment in advance is possible.

(2) If payment is made in advance, the goods will be dispatched after receipt of payment. In the case of payment by direct debit or credit card, the amount will be debited when the goods leave the warehouse. In the case of delivery on account, the amount due must be transferred to the account specified on the invoice within 10 days of receipt of the invoice.

(3) You will be informed of the bank details in the order confirmation, which will be sent to you by e-mail after completion of the order process, as well as on the invoice.

Applicable law

The law applicable to the contracts is the national law of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
